General Information

As a provider of Internet/World Wide Web access, web site hosting, and other Internet-related services, Exotecho, Ltd. (“the Company”) offers its customers, the means to acquire and disseminate a wealth of public, private, commercial, and non-commercial information.

The Company respects that the Internet provides a forum for free and open discussion and dissemination of information, however, when there are competing interests at issue, the Company reserves the right to take certain preventative or corrective actions.

In order to protect these competing interests, the Company has developed this Acceptable Use Policy (“AUP”), which supplements and explains certain terms of each customer’s respective service agreement and is intended as a guide to the customer’s rights and obligations when utilizing the Company’s services.

This AUP will be revised from time to time. A customer’s use of the Company’s services after changes to the AUP are posted on the Company’s web site, www.exotecho.com under the Legal Details section, will constitute the customer’s acceptance of any new or additional terms of the AUP that result from those changes.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet’s openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that the Company cannot monitor, verify, warrant, or vouch for the accuracy and quality of the information that users may acquire. For this reason, the user must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet is sexually explicit or otherwise offensive. Because the Company cannot monitor or censor the Internet, and will not attempt to do so, the Company cannot accept any responsibility for injury to its users, customers or subscribers that results from inaccurate, unsuitable, offensive, or illegal Internet communications.

When users, customers or disseminate information through the Internet, they also must keep in mind that the Company does not review, edit, censor, or take responsibility for any information its users, customers or subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Also, because the information they create is carried over the Company’s network and may reach a large number of people, including both customers and subscribers and non-subscribers of the Company, customers’ and subscribers’ postings to the Internet may affect other customers and subscribers and may harm the Company’s goodwill, business reputation, and operations.

For these reasons, customers and subscribers violate the Company policy and the service agreement when they, their customers, affiliates, or subsidiaries engage in activities described herein.

Scope

This AUP governs the usage of the Company’s products and services (the “Services”). This AUP is incorporated by reference into each contract the Company enters into with a customer (each, a “Customer”) for the use of such Services. the Company may modify this AUP at any time without notice. In addition, this AUP is incorporated by reference into the Terms of Service applicable to the Company’s Web site so that no person who utilizes the Company’s Web site (regardless of whether that person is a Customer) may take any action utilizing the Company’s Web site that a Customer would be prohibited to take utilizing the Services.

Purpose

Prohibited Content

The following is a list of content that is not accepted in our servers and network:

  1. Any type of activity that can lead to the IP being blocked by organizations such as Spamhaus
  2. Under Legal Age Nudity
  3. Pornography
  4. Scam/Fraudulent Websites
  5. Spam
  6. Illegal Pharmaceutical Websites
  7. Pishing Websites
  8. DDoS Scripts
  9. Mass Mailing (Mail Spamming)
  10. Reverse Proxies
  11. Selling Illegal Substances
  12. Phishing Websites
  13. Botnet Controllers
  14. Brute Force Attacks
  15. Packet Flood Scripts
  16. SIP Scanners
  17. IP Spoofing Attacks
  18. Virus, Trojan and Malware distribution
  19. Scanning of password and password guessing tools, bots and/or software
  20. Vulnerability scanners
  21. Terrorist Websites
  22. Immoral Websites
  23. Unlicensed services
  24. Crypto Mining

The list may get updated:

  1. Upon encountering new types of unallowed content or use cases.
  2. Upon changes in use policies by datacenters.

Any other content not included in the previous list is considered as Allowed.

Content Considerations

The following is a list of restrictions that apply to the specified operations in our servers and network.

  1. Content must comply with UK laws and the laws of the country where the data is hosted.
  2. We do not censor our members on the basis of content as long as it complies with our policies. The Customer is fully responsible of the content, posts, articles hosted in our servers or network. Complainer should forward copy of competent English court order in order to request content removal, in the case that this is not possible the complainer will need to work directly with the Website operator to resolve the situation.
  3. Use of unlicensed software: Exotecho Ltd does not monitor what software a Customer is installing in our Servers. The Customer is fully responsible of getting appropriate software licensing. In the event of a complaint received from a software company we may request to remove the software or get a valid license for it in order to continue operating in our network.

Shared Hosting Considerations

Shared Hosting Plans may involve specific limitations on initially unlimited specifications in case of abusive use.

  1. We reserve the right to apply Bandwidth limitations on Shared Hosting Plans if we notice any abusive or excessive use that can be considered outside the scope of a typical Web hosting use (e.g. video/file sharing).
  2. Database sizes on Shared Hosting Plans are Unlimited but may be subject to limitations (MySQL IO limitations) in case of abusive use (e.g. large databases above 2GB or high load databases).

Force Majeure

In no event shall Exotecho, Ltd be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services; it being understood that Exotecho, Ltd shall use reasonable efforts which are consistent with accepted practices in the banking and hosting industries to resume performance as soon as practicable under the circumstances.
